Court-Based Patent Reform

Congress is considering making well-publicized reforms that would overhaul the U.S. patent system. However, the Supreme Court and the Court of Appeals for the Federal Circuit (CAFC) have already begun substantially changing the rules of the patent game.

A number of recent major court decisions have chipped away at the rights of patent owners. Should legislative reforms be signed into law as well, the collective effect of the changes in statutory law and case law will be profound.
